Design Registration Process
Design Search
A prior art search is conducted to verify whether the design is new and not already registered or published.
Preparation of Design Drawings
High-quality line drawings or images are prepared from all required views: front, back, top, bottom, left, right, and perspective view.
Filing Design Application
The design application is filed with complete details including class, description, drawings, and representation of the article.
Examination by Design Office
The Design Office examines the application to check novelty, originality, and compliance with legal requirements.
Reply to Examination Report
If objections are raised, a detailed reply along with clarifications and supporting documents is submitted.
Registration & Certificate Issued
Once approved, the design is registered and published in the Design Journal, and the registration certificate is issued.
Validity
Design registration validity and renewal:
Initial Validity
Design registration is valid for 10 years from the date of registration.
Renewal
It can be renewed for an additional 5 years.
Maximum Protection
Maximum protection available is 15 years (10 + 5 years).
After Expiry
After expiry, the design goes into the public domain and anyone can use it legally.
